URBAN BABY WARRANTY TERMS 

Subject to our Terms of Use, any product that is explicitly stated as having a warranty by Urban Baby, shall be warranted in accordance with these terms.

Urban Baby warrants to customer that the products sold by Urban Baby shall be free from major defects in material and workmanship. The foregoing warranty shall expire at the end of the respective warranty period stated on the product's web page on our site.

If any such defect of is discovered during the warranty period, the customer shall promptly notify Urban Baby in writing, including on such notification all information that will allow Urban Baby to ascertain to its satisfaction the applicability of a warranty (including, but not limited to, descriptions, pictures, videos, receipts). Urban Baby shall thereupon correct such defect by, at its option, repairing or replacing the defective product(s). If despite Urban Baby's  reasonable efforts, a defective product cannot be repaired or replaced, Urban Baby will provide the customer a refund equal to the price paid by the customer for the defective product, excluding the price of shipping as described below.

If Urban Baby authorizes the return of a product subject of a warranty claim, the customer shall be responsible for the cost of suitable packing and shipping of the product to the address designated by Urban Baby staff. Urban Baby shall be responsible for the cost of packing and shipping the repaired or replacement product back to the customer. Replacement products provided as a warranty remedy may be renewed or refurbished.

 Minor cosmetic damage is not covered by warranty.

All products which are not explicitly identified on their respective web page as being warranted, are provided to you 'as is', without any representation,  warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

The preceding paragraphs of these Warranty Terms set forth the exclusive remedies for all claims based on a failure or defect in the product, whether the failure or defect arises before or during the applicable warranty period and whether a claim, however instituted, is based on contract, warranty, indemnity, tort/extracontractual liability (including negligence), strict liability or otherwise, and are in lieu of all other warranties and guarantees whether written, oral, implied or statutory. No implied or statutory warranty, or warranty or condition of merchantability or fitness for a particular purpose shall apply.

THE TOTAL LIABILITY OF BAUSALA (THE OWNER OF THE URBAN BABY BRAND) FOR ALL WARRNTY CLAIMS OF ANY KIND, WHETHER BROUGHT UNDER CONTRACT, TORT OR OTHERWISE SHALL BE SUBJECT TO THE INDEMNITIES, EXCLUSTIONS AND LIMITATIONS OF LIABILITY STATED IN OUR Terms of Service.
